What is national phase? The national phase is the second of the two main phases of the PCT procedure. It follows the international phase and consists in the processing of the international application before each Office of or acting for a Contracting State that has been designated in the international application (see International Phase ). In each designated State the international application has the effect of a national (or regional) application as from the international filing date. See full list on wipo.
Where the national law of a PCT Contracting State provides for patent protection through the extension of a European patent, the national phase takes place, in effect, before the European Patent Office (see International Phase , paragraph 54). The first phase is the international phase in which patent protection is pending under a single patent application filed with the patent office of a contracting state of the PCT. The second phase is the national and regional phase which follows the international phase in which rights are continued by filing necessary documents with the patent offices of separate contracting states of the PCT.
